Terms of service

Supplemental professional terms for the account, cloud service and data, together with Apple’s Standard EULA for the app licence.

Apple Standard EULA

1. Eligibility and professional use

My Estate Map is contractually reserved for professionals who are at least 18 years old or the age of legal majority in their jurisdiction and have authority to bind their business. By creating or using an account, the user confirms professional use.

2. Contract and licence

Apple’s Standard End User License Agreement governs the app licence. These supplemental Terms govern the My Estate Map account, cloud service, professional data processing and subscription-related service. If a mandatory Apple term conflicts with these Terms, that mandatory term controls for the app licence.

3. Account

The customer must provide accurate information, protect authentication access and notify support of suspected misuse. One person must not use another person’s account without authorization. The customer is responsible for actions performed through its authorized access.

4. Customer content and authority

The customer retains rights in content it provides and grants LE LAB IMMO the limited rights needed to host, synchronize, display, protect and delete it as part of the service. The customer warrants that it has a lawful basis and authority to process owner, contact, property and appointment data and to give the instructions contained in the DPA.

5. Acceptable use

  • Do not use the service unlawfully, deceptively or to infringe another person’s rights.
  • Do not upload malicious code, attempt unauthorized access, probe security or interfere with the service.
  • Do not resell, reverse engineer or copy the service except where mandatory law permits it.
  • Do not use the service as a source of unsolicited marketing data or upload special-category data unless strictly necessary, lawful and appropriately protected.

6. Subscription, trial and Apple billing

Weekly, monthly and annual auto-renewable subscriptions are sold through Apple. Only an eligible annual subscription can include a 14-day introductory free trial. The localized StoreKit price and terms shown in the app at confirmation control.

Apple manages payment, renewal, billing-period changes, cancellation and refunds under the customer’s Apple account and applicable Apple rules. The subscription renews unless cancelled in Apple settings within Apple’s required timeframe. Deleting the My Estate Map account does not cancel an Apple subscription; cancellation must also be completed with Apple.

7. Availability and changes

LE LAB IMMO aims to provide a reliable service but does not promise uninterrupted or error-free availability. Maintenance, provider incidents, security requirements and legal changes may affect access. Material reductions will be communicated when reasonably possible.

8. Suspension and termination

Access may be suspended to protect security, comply with law, address non-payment or stop a material breach. The customer may stop using the service and may request account deletion. Portfolio retention after a paid entitlement ends follows the Privacy Notice; manual account deletion triggers full deletion subject to legal retention duties.

9. Intellectual property

My Estate Map, its software, brand, design and documentation belong to LE LAB IMMO or its licensors. No ownership transfers to the customer. Feedback may be used without restriction provided it does not disclose confidential customer content.

10. B2B warranties and liability

The service supports field organization and does not replace professional, legal, accounting, valuation or transaction systems. To the fullest extent permitted for a B2B contract, indirect loss, lost profit, lost opportunity and loss caused by unauthorized or unlawful customer data are excluded. Liability that cannot legally be excluded remains unaffected. Any other aggregate liability is limited to the amounts paid for the service during the 12 months preceding the event giving rise to the claim, except in cases of gross negligence, wilful misconduct, personal injury, confidentiality or data-protection liability where such limitation is prohibited.

11. Governing law and disputes

French law governs these Terms. The parties will first attempt an amicable resolution. Where the law permits a contractual choice of court between professionals, the competent courts within the jurisdiction of Nîmes, France, have exclusive jurisdiction.

12. Contact and changes

Questions and notices may be sent to support@myestatemap.app. Updated Terms identify their effective date. Material changes are communicated before taking effect when required; continued use after the effective date constitutes acceptance where legally valid.

Annex — Data Processing Addendum (GDPR Article 28)

This DPA applies when the customer acts as controller and LE LAB IMMO processes professional portfolio content on the customer’s behalf.

  1. Object and duration

    The processor handles portfolio content solely to provide My Estate Map for the duration of the customer account and the retention period described in the Privacy Notice.

  2. Data and people

    Data can include owner/contact identity and contact details, property addresses, notes, appointments, imports and photos. Data subjects can include owners, prospects, clients and professional contacts of the customer.

  3. Documented instructions

    LE LAB IMMO processes portfolio content only on the customer’s documented instructions embodied in these Terms and in-app actions, unless Union or Member State law requires otherwise.

  4. Confidentiality and security

    Persons authorized to process the data are bound by confidentiality. Appropriate technical and organizational controls include access restriction, encrypted transport, account isolation, provider controls and deletion procedures.

  5. Sub-processors

    The customer gives general authorization for Firebase/Google, Apple, Mistral AI when the optional feature is requested, and infrastructure providers identified in the Privacy Notice. LE LAB IMMO remains responsible for equivalent data-protection obligations and will give reasonable notice of a material replacement.

  6. Assistance

    Taking account of the nature of the processing, LE LAB IMMO will reasonably assist the customer with data-subject requests, security, impact assessments and regulator consultations. Additional work beyond normal service may be charged when permitted and agreed in advance.

  7. Incidents

    LE LAB IMMO will notify the customer without undue delay after becoming aware of a personal-data breach affecting portfolio content and will provide available information reasonably needed for the customer’s obligations.

  8. Deletion and return

    Portfolio content is available through the service while access is effective. It is deleted according to the retention schedule or account-deletion request, including from backups within the stated maximum period, unless law requires retention.

  9. Information and audit

    LE LAB IMMO will make information necessary to demonstrate Article 28 compliance available. Audits must be proportionate, protect other customers and security, avoid unnecessary disruption, and ordinarily begin with documentation before an on-site review.

  10. Controller duties

    The customer remains responsible for a lawful basis, transparent information, data accuracy, access permissions and instructions. The customer must not upload data that it is not authorized to process.
